Dr. Joe Philip files $10 million lawsuit against health unit

Dentist calls investigation 'groundless and unprecedented'

Following the groundless and unprecedented attack on the reputation of Dr. Joe Philip’s practice by the Simcoe Muskoka District Health Unit (SMDHU), Dr. Joe Philip and his practice have issued a statement of claim against SMDHU to give him his day in court.

At the time of the SMDHU’s media statements and website release of a ‘lapse report’ against the practice, Dr. Philip and SMDHU were actively involved in an appeal regarding SMDHU’s intent to communicate with Dr. Philip’s patients. Instead of allowing the independent body that oversees public health units to do their job, SMDHU chose instead to release a damaging media statement and ‘lapse report’.

Dr. Philip’s dental practice, Wyandotte Medical and Dental Centre remains open to the public and our team continues providing important care to our patients and is intent on holding the SMDHU accountable for its actions in court.

There continue to be no reports of any patients being exposed to any transmittable disease as a result of care provided by Dr. Philip or a member of his team. The Royal College of Dental Surgeons of Ontario has investigated the matter in parallel to the SMDHU and their experts found no concerns, nor do they agree with the unproven claims and actions of the SMDHU.

The allegations by SMDHU are false and without merit.

“I’ve dedicated my professional life to the health and wellbeing of children from all walks of life and a wide range of needs. I would never do anything that put patient safety at risk and was shocked when the SMDHU chose to destroy my reputation and my practice for exercising my rights to appeal their factually incorrect orders,” Dr. Philip said. “The fact that the SMDHU revoked their order to produce patient records after publicly humiliating me, underscores my belief that even they did not have any genuine concern with how I run my practice.”
