Penetanguishene driver charged with impaired following crash into tree

PENETANGUISHENE, ON - At 3:01 a.m. Oct.  25, 2019 members of the Southern Georgian Bay Detachment of the Ontario Provincial Police (OPP) were dispatched to a single vehicle crash into a tree on Fuller Avenue, Town of Penetanguishene after receiving a report from a member of the public.

Attending officers located the lone driver who was not injured at the scene and after speaking to the driver entered into a drinking and driving investigation along with the crash investigation. As a result of these investigations Hand Nicholas Klemm, 41 years,of Penetanguishene has been charged with the following offences;

  • CC 320.14(1)(a) Operation while impaired - alcohol and drugs
  • CC 320.14(1)(b) Operation while impaired - blood alcohol concentration (80 plus)

contrary to the Criminal Code of Canada

and further

  • CAIA 2(1)(a) Operate a motor vehicle without insurance

contrary to the Compulsory Automobile Insurance Act

The accused has been released from police custody on a recognizance to appear before the Ontario Court of Justice in Midland on November 7, 2019. The involved vehicle was towed and impounded for 7 days and the accused's driver's licence has been suspended for 90 days under the conditions of the Administrative Drivers Licence Suspension (ADLS) .

Police remind motorists that an essential part of the enforcement job is to save lives and reduce injuries on our roadways and trails. Educating the public about safe driving practices is a priority.
