Members of the Marine Unit from the Southern Georgian Bay Detachment of the Ontario Provincial Police (OPP) while on patrol at 4:24 p.m. Oct. 3, 2020 had an occasion to check on a pontoon vessel as it appeared to be having difficulty near the shoreline of Snake Island on the waters of Georgian Bay.
Officers spoke with the operator after rendering assistance to the vessel and entered into a drinking and driving investigation. A roadside screening device (ASD) test was conducted by the officers on the driver who produced a "fail" result and further investigation back at detachment was conducted. A search of the vessel also resulted in a quantity of liquor being seized.
As a result of this investigation Lukasz Stanislawski, 36 years, of Toronto has been charged with the following offences:
- Operation while impaired - blood alcohol concentration (80 plus) contrary to the Criminal Code of Canada
- Operating boat underway with open container of liquor contrary to the Liquor Licence Act • Operating pleasure craft without copy of licence on board contrary to the Canada Shipping Act
- Failure to have proof of competency on board a pleasure craft contrary to the Canada Shipping Act
- Fish without having licence on your person contrary to the Fish and Wildlife Conservation Act
The accused was served a 90-day driver's licence suspension and seven day vehicle impound as per the Ministry of Transportation (ADLS) program and will appear before the Ontario Court of Justice in Midland on Dec. 10, 2020.
